Buddy's practice has encompassed domestic and international antitrust issues of all varieties.  He has represented clients in litigation in federal district and appellate courts and in regulatory matters before the U.S. Department of Justice, the Federal Trade Commission, and State Attorneys General.  Buddy has also advised clients in dealings with the European Commission and China’s Ministry of Commerce.

Buddy recently represented the State of Utah as a Special Assistant Attorney General with the Antitrust & Data Privacy Section of the Attorney General's Office in the multistate antitrust suit against Google challenging its Play Store practices.  In that capacity, Buddy was the sole examiner for plaintiffs in the depositions of SlideME's CEO and a TIDAL executive and represented the States in deposing two senior Google executives and an Nvidia witness.  In its related trial win against Google, Epic Games played clips of Buddy's cross-examination of an OCV deponent.

Antitrust Litigation

 

Buddy has been part of teams handling bet-the-company antitrust litigation in multiple industries, including matters nominated for the Global Competition Review’s award for Litigation of the Year:

  • Successfully represented plaintiff medical company in obtaining a preliminary injunction and on appeal from the same in a federal action alleging exclusionary cartel conduct.  The appeal was withdrawn and the matter settled on favorable terms.  

  • Obtained dismissal of state and federal consumer protection and antitrust claims on behalf of a pharmaceutical company regarding drug pricing.

  • Represented an auto-parts manufacturer in successfully opposing class certification in multi-district antitrust litigation, which led to a favorable settlement. 

  • Represented an online booking company in its successful defense against litigation challenging pricing practices.​

Merger Review and Regulatory Representation

  • Represented The Dow Chemical Company in its $130 billion merger-of-equals with E.I. du Pont de Nemours & Company, which received the Global Competition Review’s 2018 award for Matter of the Year.

  • Represented a telecommunications company in its acquisition.  Buddy managed outreach and responses to State Attorneys General across the country.  He also drafted written advocacy and demonstrative materials for submission to the Department of Justice and Federal Communications Commission as part of their regulatory review.  The transaction ultimately closed after receiving approval from both agencies.

  • Represented a chemical manufacturing company in its ten-figure merger-of-equals.  Buddy prepared merger notification filings and managed a multi-product second request investigation by federal authorities.

  • Represented Warburg Pincus and Electronic Funds Source LLC in the latter’s $1.5 billion acquisition by WEX Inc., which was cleared without divestiture by the Federal Trade Commission.

Select Additional Litigation Experience​

  • Represented a sovereign in multiple cert petitions to the Supreme Court in debt restructuring litigation.

  • Pro bono matters, including representing clients in a T-Visa application, an application for criminal resentencing, and an individual plaintiff in an employment discrimination matter.

Buddy was born in Baton Rouge, Louisiana and grew up in the Boston area. He received his B.A. from the University of Rochester.  Buddy graduated from the Georgetown University Law Center in 2014, where he was an articles and notes editor of the American Criminal Law Review.  In his first year of law school, he received a CALI award for best exam in contracts.

While at Georgetown, Buddy was a research assistant to Dr. Heidi Li Feldman and a judicial intern for the Hon. Denny Chin of the U.S. Court of Appeals for the Second Circuit.  He also represented tenants in eviction cases in the Law Students in Court legal clinic.  Prior to joining the Benedict Law Group, Buddy was an antitrust and litigation associate at Cleary Gottlieb Steen & Hamilton LLP in Washington, DC.
