On December 27, 2024, Benedict Law Group PLLC filed a brief on behalf of Asian Americans Advancing Justice | AAJC (“Advancing Justice-AAJC”) and the Fred T. Korematsu Center for Law and Equality as amici curiae supporting none of the parties in the consolidated challenge in the U.S. Supreme Court by TikTok and others to the Protecting Americans from Foreign Adversary Controlled Applications Act. The brief detailed the concerns the Act raises for the Asian American community, arguing that targeting speech based on national domicile is viewpoint discrimination that echoes past and current examples of anti-Asian bias and that the Court should carefully scrutinize purported national security justifications.
The brief has been covered by Axios (subscription required), the Legal Information Institute at Cornell Law School, and George Washington University writing professor Zachary Wolfe, Esq., among others.
Firm principal Brendan Benedict served as counsel of record, with assistance from Of Counsel Michael D. Altebrando, and co-counseled with Noah B. Baron, Shalaka Phadnis, and Alizeh Ahmad of Advancing Justice-AAJC.
The matters are TikTok, Inc. v. Garland, No. 24-656 and Firebaugh v. Garland, No. 24-657 in the U.S. Supreme Court.
